Weekly Events 
General Rules

By downloading certain Gameloft applications, you may be offered the chance to participate in Weekly Events (referred to individually as an “Event”). No additional purchase is necessary to enter or win. CONTEST VOID WHERE PROHIBITED BY LAW, RULE OR REGULATION AND OFFERED ONLY TO THOSE AGED 13 OR OLDER.
Entry and participation in Events constitutes your full and unconditional agreement to these General Rules. 

In the event you download a game application (“Application”) which offers an Event, you will have the ability to participate in such Event. To participate in an Event, you must select the “Events” icon on the welcome screen of your Application, which will take you to the Event section. Each Event will be open for the period indicated in the Event section. From the Event section, you can enter the game to compete. You will complete your turn and then return to the consolation prizes screen, where you will be able to review the leaderboard standings. 

You can retry as many times as you like until the Event ends. You will be able to check your score on the leaderboard during the Event period and/or once the Event ends. 

Event prizes generally consist of virtual currencies and in-game assets, but may also include special prizes (collectively referred to as “Event Prizes”), all of which will be described in the applicable Event section. The winner of an Event (“Winner”) will be determined to be the player who is in the #1 position on the applicable leaderboard at the time the Event ends. 

If you are the Winner of an Event, you will be notified in one of two ways: (1) You can check the leaderboard after the end of the Event and if you are #1, you can select “I ACCEPT MY PRIZE” to receive your Event Prize; or (2) you may receive a pop-up on your screen when entering the application notifying you of your win and asking you to accept your Event Prize by selecting “I ACCEPT MY PRIZE.” If you win special prizes, Gameloft will contact you through the game and prompt you to confirm that you want to receive the prizes.

By participating in an Event, you will have the option to purchase (a) virtual currency, including but not limited to virtual coins, cash, tokens, or points, all for use in the Event; (b) virtual in-game items; and/or (c) certain in-game benefits (collectively referred to as “Virtual Items”). You acknowledge and agree that certain Virtual Items will make it easier for players to win certain Events. 

Gameloft is not responsible for: (1) any incorrect or inaccurate information, whether caused by your actions/inactions, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Events; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the submission process or the Events; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Events, the uploading, the processing of participation, the announcement of the Event Prizes or in any Events-related materials; (5) late, lost, undeliverable, damaged or stolen communications; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant’s participation in the Events or receipt or use or misuse of any prize. Gameloft is not responsible for misdirected or undeliverable participation or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, intercepted, garbled or delayed computer transmission or any combination thereof. Gameloft is not responsible for any third-party actions within any Event. The clock for time-keeping purposes will be that of Gameloft.

Gameloft reserves the right to cancel, suspend and/or modify any Event, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Events, as determined by Gameloft at its sole discretion. If terminated Gameloft may, at its sole discretion, determine the Winners from among all non-suspect, eligible participations received up to the time of such action using the judging procedure outlined above. Gameloft reserves the right, at its sole discretion, to disqualify persons whose eligibility is in question or who cannot or do not comply with these General Rules, or for any other reason whatsoever. Gameloft, at its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the submission process or the operation of the Events or to be acting in violation of these General Rules or those of any other promotion or in an unsportsmanlike or disruptive manner and void all associated participations. Any attempt by any person to deliberately undermine the legitimate operation of the Event may be a violation of criminal and civil law, and, should such an attempt be made, Gameloft reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Gameloft’s failure to enforce any term of these General Rules shall not constitute a waiver of that provision. All decisions of Gameloft on all matters relating to the Events are final.

By participating in an Event, you agree to release, indemnify, defend and hold Gameloft, and its respective parent, affiliates, subsidiaries, directors, officers, employees, and agents, including advertising and promotion agencies, and assigns, and any other organizations/entities related to the Event such as Gameloft’s licensors (collectively referred to as “Releasees”) harmless from any and all claims, injuries, damages, expenses, or losses to person or property and/or liabilities of any nature that in any way arise from participation in the Event or acceptance or use of a prize or parts thereof, including without limitation (i) any condition caused by events beyond Releasees’ control that may cause the Event to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential, or otherwise) of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Event; and (iii) any printing or typographical errors in any materials associated with the Event.

Except where prohibited, your participation in an Event constitutes consent to the perpetual, worldwide, royalty-free use of your name and/or username to promote Gameloft or the Events.

Except where prohibited, you agree that: (1) Any and all disputes, claims and causes of action arising out of or connected with the Events or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the courts of the State of California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs you incurred, including costs associated with entering the Events, but shall specifically exclude attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Each of the parties hereby submits itself to the exclusive jurisdiction and venue of the court of the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these General Rules, or your rights and obligations in connection with the Events, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California.
